Maine Rolls Out Paid Family Leave: A Win for Workers and Families

Maine is launching a Paid Family and Medical Leave Program to support workers during major life events like illness or caring for family members.

The rules are finalized, and tax collections begin in January 2025, with benefits starting in May 2026. Here’s what it means for you.

How It Works

  1. Payroll Tax Starts in 2024

    • A 1% payroll tax will fund the program, shared equally between employers and employees.
    • Small businesses with fewer than 15 workers are exempt from the employer contribution, but employees will still pay 0.5%.
  2. Benefits Available in 2026

    • Eligible workers can receive up to 90% of their wages for up to 12 weeks for personal or family-related needs.
  3. Private Plans Allowed

    • Businesses offering equivalent private leave programs can apply to opt out of the state program starting in 2025.

Key Benefits for Workers

  • Financial Security: Protects income during illness, childbirth, or family caregiving.
  • Healthier Families: Reduces stress and improves family well-being.
  • Broader Access: Even small business employees can participate.

What Employers Should Know

  • Small Business Flexibility: Employers with fewer than 15 workers don’t contribute, but employees still get benefits.
  • Opt-Out Option: Companies with private plans can avoid double payments starting in 2025.
  • Advance Notice: Workers must give 30 days’ notice to claim benefits, except in emergencies.

Addressing Concerns

The program includes an “undue hardship” clause, allowing businesses to deny claims if fulfilling them would significantly impact operations. Worker advocates are monitoring this closely to prevent misuse.

Next Steps

  • For Workers: Get ready to apply for benefits starting May 2026.
  • For Employers: Review your leave policies and decide whether to use the state program or offer a private alternative.
